スリランカでは、訴訟とADR（裁判外紛争解決）の両方の仕組みを通じて、ビジネスや投資に関する紛争を解決するための確立された法的枠組みが整備されています。ADRには、交渉、調停、斡旋、仲裁が含まれ、裁判手続きに代わる効率的かつ柔軟で費用対効果の高い選択肢を提供すると同時に、相手方とのビジネス関係の維持にも寄与するものとなっています。

特に仲裁は、国境を越えた取引において重要な役割を果たしています。スリランカの1995年法律第11号「仲裁法」は、主にUNCITRALモデル法に準拠しており、国内仲裁および国際仲裁のための現代的な法的枠組みを提供しています。スリランカはニューヨーク条約（1958年）の締約国であり、外国仲裁判断の承認・執行に大きな支障はないため、外国の投資家にとってより大きな確実性と信頼がもたらされています。

本セミナーでは、スリランカにおける紛争解決の枠組み、適用される法原則、そして、日本の投資家や企業がスリランカでの投資や事業展開を行う際に理解しておくべき実務上の考慮事項について実例を交えて概説いたします。
 

Sri Lanka offers a well-established legal framework for resolving commercial and investment disputes through both litigation and Alternative Dispute Resolution (ADR) mechanisms. ADR methods, including Negotiation, Mediation, Conciliation, and Arbitration, provide efficient, flexible, and cost-effective alternatives to court proceedings while helping preserve business relationships.

Arbitration plays a particularly important role in cross-border commercial transactions. Sri Lanka's Arbitration Act, No. 11 of 1995, which is largely based on the UNCITRAL Model Law, provides a modern legal framework for domestic and international arbitration. As a Contracting State to the New York Convention (1958), Sri Lanka recognizes and enforces foreign arbitral awards, providing greater certainty and confidence for international investors.

This seminar provides an overview of Sri Lanka's dispute resolution framework, the applicable legal principles, and practical considerations, with some actual examples, that Japanese investors and businesses should understand when investing or conducting business in Sri Lanka.
