As in Japan, labor laws protect workers in foreign countries and any company violating these laws may be subject to administrative sanctions and criminal penalties in those countries. The provisions of foreign labor and employment laws may differ significantly from those of Japan so it is extremely important for Japanese companies expanding internationally to understand and comply with the labor and employment laws of the countries and regions where their overseas subsidiaries are located. Atsumi & Sakai is able to provide advice and support for overseas subsidiaries’ HR and labor issues (such as implementing unified global HR systems and policies, assigning officers and employees to overseas subsidiaries, overseas corporate reorganizations and personnel reductions, dismissal of officers of overseas subsidiaries, etc.) through our overseas offices and in collaboration with overseas law firms.
Our employment team includes foreign lawyers familiar with the principles of the labor laws in a number of other jurisdictions, including the US, the UK, The Peoples’ Republic of China, Germany, Australia, and India.
