Labor Disputes

Atsumi & Sakai has extensive experience advising both domestic and foreign clients on labor disputes in Japan, with our employment team comprising expert Japanese lawyers and foreign lawyers familiar with the nuances of Japanese labor law. We represent clients in collective bargaining sessions with labor unions of which their employees are members, or negotiate with lawyers retained by employees. We represent our clients in litigation, labor tribunal procedures and other legal proceedings. We directly communicate with general counsels or global/APAC HR heads of clients to discern solutions at every phase. We also have an internal translation team for translation of documents received from or submitted to tribunals and courts.

We can assist with:

  • Evaluating employee conduct and performance
  • Warning procedures and notices
  • Redundancy schemes
  • Voluntary resignations due to elimination of position and other labor reduction measures (i.e., redundancy)
  • Termination negotiations and settlements
  • Harassment/misconduct actions
  • Industrial accidents
  • Employee safety
  • Health & welfare
  • Disciplinary action
  • Labor Tribunal and other hearings
  • Provisional dispositions
  • Communications with labor unions and government agencies
  • Media relations
  • Translation services
